Nebraska’s highest court rules that the cigar lounge and tobacco retailer smoking exemption are unconstitutional.

The Nebraska Supreme Court on struck down exceptions to the state’s public smoking ban for cigar bars and tobacco shops. While the law banned smoking in all public buildings and private businesses, including bars and restaurants, it provided exceptions for cigar bars, some hotel rooms, and tobacco-only retailers. The court found that the exception for hotel rooms is permissible because hotel guest rooms are similar to private homes, but exceptions for cigar bars and tobacco retailers amounted to unconstitutional special legislation.
