Lawsuit about FDA importation ban of e-cigarettes into the USA pending appeal

On April 2, 2010, the U.S. Court of Appeals (District of Columbia) ruled that the FDA can ban the importation of e-cigarettes into the USA, during the pending of a lawsuit filed by the e-cigarette company plaintiffs. The U.S. Court of Appeals reversed a lower court decision that disallowed the FDA from banning the importation of e-cigarettes while the litigation proceeded. On May 24, 2010, the FDA filed its appellate brief for the pending lawsuit being heard by the District of Columbia Court of Appeals, in its e-cigarettes lawsuit, and national tobacco control organizations filed an amicus brief on behalf of the FDA’s case. All court papers on this appeal are due by July 22, 2010.
