Experts: Massachusetts Supreme Judicial Court’s tobacco ruling could pave way for suits (Boston Herald)

Read a June 13, 2013 Boston Herald news article about the Massachusetts Supreme Judicial Court decision in Evans v. Lorillard, which found that Newport cigarettes are “defective” products so the risk of harm of Newport menthol cigarettes could have been reduced by a “reasonable alternative design” such as a cigarette with a non-addictive level of nicotine. They upheld the ruling of $35 million in compensatory damages against Lorillard, but vacated and remanded for further proceedings other aspects of the case including whether Lorillard contributed to Evan’s death through negligent design and marketing of menthol cigarettes.
