The March 2015 edition of the Journal of Occupational & Environmental Medicine published “Guidance to Employers on Integrating E-Cigarettes/Electronic Nicotine Delivery Systems Into Tobacco Worksite Policy” which discusses the health concerns with electronic smoking devices and then outlines key policy recommendations for employers to consider, including a recommendation to ban the use of electronic smoking devices at worksites. Such recommendations should be incorporated into worksite tobacco prevention programs and control policies.
Employers should consult with their attorneys to ensure compliance with applicable local, state, and federal laws. Employers should review applicable state and local laws regulating e-cigarette use that might already exist in their cities or states.
In New Jersey, electronic cigarettes have been included in the New Jersey Smokefree Air Act which bans smoking in certain workplaces since 2010.
